L’eredità costituzionale di Next Generation EU e del Piano Nazionale di Ripresa e Resilienza: elementi per un primo bilancio prospettico

This paper aims to draw a first, and necessarily provisional, balance about the potentially long-lasting repercussions of the Next Generation EU and the NRRP on the Italian legal system, with particular regard to the formation and implementation of policy. From this point of view, we will first analyse the form of government, in an interpretative key that moves from the assumption of the interdependence between national and European institutions, assuming as a working hypothesis the stabilisation of the "NRRP model" (in the terms that will later be specified) within the new European economic governance. Attention will then be focused on the processes of normative production, and in particular on decrees-law, because of the biunivocal link that binds the legal system, on the one hand, with the form of state and the form of government, on the other. In the same logic and in strict consequentiality with the first two parts - looking at regulations and bureaucratic offices as instruments for defining and implementing policy - the aspects connected with regulatory simplification and administrative simplification will finally be dealt with.
