Bundesgesetz, mit dem ein Sterbeverfügungsgesetz erlassen wird sowie das Suchtmittelgesetz und das Strafgesetzbuch geändert werden |
Subject area |
Fundamental rights; ECHR. |
Brief description of the contents of the act |
The Federal Law complies with a ruling of the Constitutional Court on assisted suicide (ruling G139/2019 of 11.12.2020). The central concern is to implement the fundamental right to self-determination and at the same time to safeguard it against abuse. The new regulation therefore includes, in addition to strict conditions, for example concerning the most serious illnesses, a procedure to be followed with doctors, the observance of a period of reflection, the effective establishment of an advance directive and the controlled dispensing of a preparation through pharmacies. It is limited to the question under which conditions it should be permissible in future to assist someone in suicide. In the case of killing another person at their request, criminal liability persists. |
Comment |
The previous ban on assisting suicide was overturned by the Constitutional Court with effect from 1 January 2022. The government had therefore to present a new legal regulation. |
