Le ragioni di nuove istruzioni e raccomandazioni sulla qualità della regolazione: una rinnovata attenzione per il drafting sostanziale

Twenty years after the adoption of the guidelines on legislative drafting, issued in 2001 by circulars of the Presidents of the Chambers and of the President of the Council of Ministers, the update of legislative drafting rules cannot be further postponed. New technical guidelines should be provided not only for the formulation of legislative and regulatory drafts (formal drafting), but also for strengthening tools and procedures aimed at improving the quality and the effectiveness of regulation for citizens (substantive drafting). The essay critically analyses consequences of badly designed laws and highlights areas of legislative production that should receive further attention and guidance. The importance of a wider reform of rules on drafting and regulatory procedures is emphasised by a recent initiative of the Department of Legal and Legislative Affairs (DAGL) of the Presidency of the Council of ministers for updating, that aims to amend and consolidate into one only document all the guidelines on legislative production. Finally, it is stressed that the challenge ahead is to develop a new approach to regulation by policy makers, based on cyclical steps of legislative production (formulation, adoption, implementation and evaluation), in order to contribute to higher quality laws and regulations.
