The essay analyzes the so-called Statute Laws of the Regions governed by special statute and the Autonomous Provinces. The Constitutional Law no. 2 of 31 January 2001 ("Provisions concerning the direct election of Presidents of the Regions governed by special statute and the Autonomous Provinces of Trento and Bolzano") has provided that the Regions with a special level of self-government can issue a strengthened regional law - passed by an absolute majority and amenable to referendum - that regulates the main organizing and practical aspects, in particular the form of government. The paper mainly surveys one of the aspects governed by the Statute Laws: the referendum. Particular attention is given to the different regulation of the abrogative, containing a proposal and consultative types. The analysis concerns the main new regulations and every issues on the compatibility of these rules with the Constitution, especially in light of the constitutional jurisprudence. The aim is to evaluate the space that the Special Regions have for an autonomous discipline of the institute and the real meaning of the limits of the “harmony with the Constitution” and the “harmony with the principles of the legal system of the Republic”.
